ATTENTION: ALL RDS Secure Web Site Users Awaiting Appeal Decisions for Applications with Plan Years Ending in 2008 or Earlier

All Retiree Drug Subsidy (RDS) Program Plan Sponsors awaiting an appeal decision regarding an RDS application with a plan year ending in 2008 or earlier should be aware that a pending appeal does NOT affect the Plan Sponsor's ability to apply for a future plan year.

Plan Sponsors that wish to continue to participate in the RDS Program should submit an application for the 2009 plan year no later than the application deadline. The regulatory application deadline (42 CFR §423.884(c)) applies regardless of whether an appeal is pending for a previous plan year’s application.
